“Montana’s U.S. Senators Steven Daines and Jon Tester may soon be able to secure Congressional passage of their ill-conceived and falsely named bill – “The Montana Water Rights Protection Act” (S. 3019).
Contrary to its short title, S.3019, if passed by Congress, will allow the federal government to give away to the Tribal Council of the Confederated Salish and Kootenai Tribes (“CSKT”) substantial portions of the state-held water rights of northwestern Montanan irrigators, municipalities, and companies, whether they are located on the Flathead Reservation or just upstream from it.
S.3019, if passed by Congress, also will allow the U.S. Interior Department and its U.S. Fish and Wildlife Service (“USFWS”) agency to give away the National Bison Range and its wildlife inhabitants to the CSKT without the consent of the American public.
If there is a political will, there certainly is a way to stop Congressional passage of the politically toxic Daines-Tester bill (S.3019).
A lawsuit can be filed against the federal agencies and officials responsible for:
(1) unconstitutionally reallocating under false pretense state held water rights on and upstream from the Flathead Indian Reservation from irrigators, companies, and municipalities to the federal government, employing the tribal trust obligation the federal government is alleged to owe the Confederated Salish and Kootenai Tribes (“CSKT”) as a cover, without paying the original water right holders just compensation; and
(2) drafting portions of S.3019 in cooperation with Montana Senators Steven Daines and Jon Tester, and with former Montana Congress Ryan Zinke, and in drafting the USFWS 2018 Comprehensive Conservation Plan (“CCP”) that are in material breach and violation of the U.S. Fish and Wildlife Service’s 2018 settlement agreement with Public Employees for Environmental Responsibility (“PEER”) intended to protect the National Bison Range against transfer to the CSKT.
This lawsuit will be filed in the U.S. District Court for the District of Columbia.
Western Constitutional Rights Protection, LLC, is a Montana-based entity intending to file such a lawsuit to protect the legal and economic interests of Montana irrigators and companies holding valuable state-designated water rights stolen by the federal government.
Save the National Bison Range, LLC, is a Montana-based entity intending to file such a lawsuit to protect the interests and rights of National Bison Range and wildlife refuge enthusiasts all throughout the United States to:
1) the historically pure genetics of the bison residing at the National Bison Range, which is now threatened by S.3019; and
2) the continued public access, for generations to come, to the National Bison Range, widely recognized as the crowned jewel of the globally unique U.S. National Wildlife Refuge System, which is now threatened by S.3019.
Western Constitutional Rights Protection, LLC, Save the National Bison Range, LLC, and Stop the Water Compact can work together on the behalf of all concerned Montanans and Americans to file this lawsuit, but they require your support.
